As an estate agency, we collect and use personal information (such as names, contact details, property requirements, financial position, and proof of identity) because it is necessary to deliver our core services: marketing properties, arranging viewings, matching buyers and tenants with suitable properties, progressing sales and lettings, and communicating with clients and applicants throughout these transactions.

This processing benefits the individuals concerned as well as our business. Sellers and landlords benefit because we can market their property effectively and identify genuine, suitable buyers or tenants. Buyers and tenants benefit because we can notify them of properties matching their stated requirements and keep them informed of progress on their transaction. It also enables us to respond to enquiries promptly, maintain accurate records, and resolve any disputes or complaints fairly.

The benefits outweigh the risks because the information we collect is limited to what individuals would reasonably expect an estate agent to need, and the processing is within their reasonable expectations: someone registering interest in a property expects to be contacted about it. We do not use the information in unexpected or intrusive ways, we do not sell it to third parties, and we keep it secure and only for as long as necessary. You can object to this processing at any time, and we make this easy to do.

For service updates and marketing

We use personal information (such as names, contact details, and property requirements or preferences) to send service updates and direct marketing. Service updates include information about the progress of a sale or letting, changes to our services and appointment reminders. Marketing includes property alerts matched to your stated requirements, market updates, and information about our services that may be relevant to you, such as valuations for past clients.

This benefits you as well as our business: buyers and tenants receive timely alerts about matching properties, sellers and landlords have their properties promoted to people with genuine interest, and clients receive relevant market information. The benefits outweigh the risks because we only send communications relevant to your relationship with us, we do not send excessive or intrusive communications, we do not sell or share your contact details with third parties for their own marketing, and we comply with the rules on electronic marketing. Every marketing message includes a clear and simple way to opt out, and we act on opt-outs promptly. We do not market to children.

Crime prevention

We may also use personal information where we need to prevent, detect or investigate a crime, including the apprehension and prosecution of offenders (a recognised legitimate interest under UK data protection law).

To comply with legal requirements, for recruitment, and for queries, complaints or claims

5. How long we keep your information

We only keep your personal information for as long as we need it for the purposes described in this notice, to comply with our legal obligations, or to deal with any complaints or claims. As a guide:

  • Records relating to a sale, letting or tenancy: for the duration of the transaction or tenancy and for 6 years afterwards, in line with limitation periods for legal claims
  • Anti-money laundering records (identification documents and verification checks): 5 years after the end of our business relationship with you, as required by law
  • Marketing information: until you opt out or until we no longer have a reason to contact you
  • Unsuccessful job applications: 6 months after the recruitment process ends
  • Call recordings: 3 years

When we no longer need your information, we securely delete or anonymise it.

 

6. How and where we store your information

Your information is stored within the United Kingdom and/or the European Economic Area ("EEA"). If we ever need to transfer your information outside the UK or EEA, we will only do so where appropriate safeguards required by data protection law are in place.

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and are subject to a duty of confidentiality.

We have procedures in place to deal with any suspected personal data breach and will notify you and the regulator of a breach where we are legally required to do so.

  • Financial or fraud investigation authorities and relevant regulatory authorities
  • Organisations we are legally obliged to share personal information with

Where third parties process your information on our behalf, we ensure it is processed securely and in accordance with data protection law.

If we sell, transfer or merge parts of our business or assets, or acquire or merge with another business, your information may be shared with the new owners, who may use it in the same way as set out in this privacy notice.

We may compile anonymised statistics about the use of our website, such as traffic and usage patterns. This data does not include any personal information and may be shared with third parties such as prospective investors, affiliates, partners and advertisers.

In certain circumstances we may be legally required to share your information, for example where we are involved in legal proceedings or complying with legislation, a court order or a governmental authority.
